Welcome to aureefragrance.com (the "Site"). The Site is owned and operated by Aurée Fragrance LLC ("Aurée," "we," "us," or "our"), a Texas limited liability company located in Texas.

Please read these Terms & Conditions ("Terms") carefully before using our Site, purchasing our products, or engaging with our services. By accessing or using any part of the Site, or by making a purchase, you agree to be bound by these Terms, as well as our Privacy Policy, Shipping Policy, and Return & Exchange Policy, which are incorporated herein by reference.

If you do not agree to all of these Terms, you may not access the Site or purchase our products.

1. General Conditions & Eligibility

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence (18 years of age in most US states).

We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site, use of the Site, or access to the Site without express written permission by us.

2. Products, Customization & Bespoke Disclaimer

• Product Descriptions: We make every effort to display the colors, packaging, and descriptions of our fragrances as accurately as possible. However, because display settings vary across screens, we cannot guarantee that your monitor's display of any color or bottle option will be completely accurate.

• Hand-Crafted / Bespoke Products: Many of our products—including custom 100 mL bottle selections, personalized scent choices, and engraved or custom-blended elements—are individual sensory creations. Slight variations in color, bottle finish, or scent nuances are natural characteristics of hand-blended and custom-crafted perfumery and do not constitute product defects.

• Availability & Modifications: All product descriptions, pricing, and availability are subject to change at any time without notice, at our sole discretion. We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction, or to discontinue any product at any time.

3. Orders, Pricing & Payment

• Pricing Errors: In the event that a product is listed at an incorrect price due to a typographical or system error, Aurée Fragrance LLC reserves the right to cancel or refuse any orders placed for products listed at the incorrect price, whether or not the order has been confirmed and your payment method charged. If your payment method has already been charged, we will issue a full refund to your original payment method.

• Order Acceptance & Right to Refuse: Receiving an order confirmation email does not signify our final acceptance of your order. We reserve the right at any time after receipt of your order to accept, decline, or limit your order quantity for any reason, including suspected credit card fraud or unauthorized reseller activity.

• Payment Processing: Payment is due at the time of purchase. All payments are securely processed through third-party payment providers. You represent and warrant that you are authorized to use the payment method provided.

4. Returns, Exchanges & Refunds

All purchases are subject to our Return & Exchange Policy, which is incorporated into these Terms:

• Final Sale Items: Custom-crafted products—including 100 mL / 3.4 oz Full Bottles with personalized scent or color selections, discovery sample sets, and gift cards—are FINAL SALE and non-returnable, non-refundable, and non-exchangeable.

• Eligible Exchanges: Items eligible for exchange under our 60-day policy must have at least 95% of their original fluid content remaining and are limited to a one-time exchange per original order.

• Damaged Items: Claims for items damaged during shipment must be reported to support@aureefragrance.com within seven (7) days of delivery with photos of the damaged item and original packaging.

5. Shipping & International Compliance

• Shipping Policy: Shipping rates, processing schedules, and estimated delivery windows are outlined in our Shipping Policy. Standard processing requires 1–3 days, while customized/bespoke orders require 1–5 days prior to dispatch.

• Carrier Transit Disclaimer: Shipments are handed over to third-party carriers (USPS, UPS, FedEx). Transit times provided on our Site are estimates. Aurée Fragrance LLC is not responsible for carrier transit delays, weather disruptions, or incorrect delivery addresses provided by the purchaser.

• International Orders: We currently do not fulfill international orders for delivery outside the United States. If you have placed an order to be delivered outside the U.S., your order will be cancelled and you will not be charged for that order.

6. Intellectual Property

All content on the Site—including but not limited to brand narrative copy, logos, trademarks, visual design elements, product photography, bottle design concepts, audio/video media, trade dress, software scripts, and user interface graphics—is the exclusive property of Aurée Fragrance LLC and is protected by United States and international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access the Site for personal, non-commercial shopping purposes only. Any unauthorized use, scraping, copying, distribution, or derivative work creation is strictly prohibited.

7. Product Usage & Safety Disclaimers

• Cosmetic & Fragrance Safety: Our products are intended for external, topical application only. Do not ingest. Keep out of reach of children and pets. Fragrances contain concentrated essential oils, synthetic aroma compounds, and cosmetic-grade alcohol; avoid application near eyes or irritated skin.

• Sensitivity & Allergic Reactions: We strongly recommend performing a patch test on a small area of skin before full use. Aurée Fragrance LLC is not liable for individual skin sensitivities, allergic reactions, or physical reactions resulting from product use. Discontinue use immediately if irritation occurs.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AURÉE FRAGRANCE LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNISHABLE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND—INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS—ARISING FROM YOUR USE OF THE SITE, PURCHASE OF ANY PRODUCT, OR ANY CLAIM RELATED IN ANY WAY TO YOUR PRODUCT USE.

IN NO CASE SHALL THE AGGREGATE LIABILITY OF AURÉE FRAGRANCE LLC EXCEED THE TOTAL AMOUNT PAID BY YOU TO AURÉE FRAGRANCE LLC FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Aurée Fragrance LLC, its managers, members, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of the Site or products, or your violation of any third-party rights.

10. Governing Law & Dispute Resolution

These Terms and any separate agreements whereby we provide you products or services shall be governed by, construed, and enforced in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.

Any legal suit, action, or proceeding arising out of or related to these Terms, the Site, or products purchased from Aurée Fragrance LLC shall be instituted exclusively in the federal or state courts located in Lubbock County, Texas. You irrevocably consent to the personal jurisdiction and venue of such courts.

11. Severability & Entire Agreement

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nevertheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any remaining provisions.

These Terms, together with our Privacy Policy, Shipping Policy, and Return & Exchange Policy, constitute the entire agreement between you and Aurée Fragrance LLC regarding your use of the Site and purchase of products.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates to our website.
